The newly approved Labor Contract Law will not undermine the investment environment although it will better protect workers' interests and rights, China's top trade union body said yesterday. Liu Jichen, director of the law department at the All-China Federation of Trade Unions, denied that the law - which goes into force from January 1 next year - is biased toward employees. "It not only protects workers' interests and rights, but also equally protects employers'," he told a press conference. The law, passed on Friday by the Standing Committee of the National People's Congress, the top legislature, had raised concerns that stricter contract requirements could raise business costs and give companies less flexibility to hire and fire employees. Liu, however, said that the law takes into account employers' interests. For example, he said, employers can sign non-competition contracts with workers, with a non-competition period of not more than two years to encourage innovation and ensure fair competition. So an employer can rest assured that an employee does not walk out at the end of the contract period and join a direct competitor. It also softens the terms under which employers can cut staff - if an enterprise switches to other production, adopts a major technological innovation or changes its mode of business. Liu stressed that the law will help create a harmonious labor relationship. "Labor protection is a worldwide trend," he said. "With working conditions improved and rights protected, employees will feel more secure, which leads to a higher productivity." Liu pointed out most labor disputes result from violations of workers' rights. Because of the huge supply of labor force, workers are in a disadvantaged position, he said. Liu said the federation has succeeded in keeping most of the items on protecting workers' rights and interests in the law. For example, the law makes mandatory the use of written contracts and strongly discourages fixed- or short-term contracts. It also stipulates severance be paid if a fixed-term contract expires but is not renewed without an appropriate reason. The law requires all employers to submit proposed workplace rules or changes for discussion to the workers' congress - concerning pay, work allotment, hours, insurance, safety, holidays and training. Employers and trade unions will then jointly decide on workplace agreements. It stipulates trade unions have the right to sign collective contracts with employers on behalf of workers. In a position paper released yesterday, the European Chamber of Commerce in China said it welcomes the law and its aim of improving labor conditions and creating workplace harmony. "A more mature legal environment should be considered as an advantage in attracting foreign investment," the statement said. However, the chamber said the key challenge remains compliance by employers and the enforcement by authorities of the existing laws.

Some 4.787 million new A-share trading accounts were opened in April, more than the combined number of the previous two years, statistics from China Securities Depository and Clearing Corporation. The figures for the new accounts are considered a rough indicator for the number of new individual investors entering the market. Analysts said the market may undergo drastic fluctation after the index breaks the 4,000 point mark, as worries about stock overvaluations build up. A pair of young giant pandas will soon call Adelaide Zoo in South Australia home.The couple will be the first pandas to settle down in the southern hemisphere - the last time the endangered species were seen was nearly two decades ago during a visit to the Australasian region .President Hu Jintao and Australian Prime Minister John Howard signed an agreement yesterday formalizing the 10-year loan in Sydney.Hu said the move is a friendly gesture and the pandas will become a symbol of friendship.Australian Foreign Minister Alexander Downer said after the signing ceremony that he played a key role in working with the Chinese to borrow the pandas as part of a global survival program."I love animals and I think the giant panda is one of the truly great animals of the world," said Downer.A native of Adelaide, Downer was excited that China agreed to send the pandas to the zoo where his grandfather was once the chief.It is hoped that the two-year-old male "Wang Wang", or "Net" and one-year-old "Funi", or "Lucky Girl", will breed when they reach sexual maturity.The two pandas are from the Wolong Nature Reserve in Sichuan Province and they were named by the public earlier this year, said Zhang Guiquan, a director at the reserve.Chris West, CEO of the Royal Zoological Society of South Australia, said that the pair's presence in Australia will signify international collaboration to secure a future for wildlife."We will send our staff to Wolong to receive training," West said. National authorities Thursday urged local governments to deal more firmly with cases of illegal land acquisitions. The move comes at a time when such cases are becoming increasingly common. A joint statement released by the Ministry of Supervision (MOS) and Ministry of Land and Resources said local government leaders should take the lead in protecting arable land. "The work to crack down on illegal land acquisition cases should be put at the top of the agenda," the statement said. The fast pace of economic development and the burgeoning property market have made land deals a lucrative prospect. The soaring land prices are filling local coffers and spurring further cases of illegal land acquisition. Land and Resources Minister Xu Shaoshi said yesterday that China must do everything it can to ensure that its arable land bank remains above the 120 million hectares red line. "Like a high voltage line, it should never be touched," he said. "Anyone encroaching upon arable land illegally will be dealt with harshly." The statement ordered local leaders to "waste no time" in "firmly supporting" the work of local supervision and land and resources officials. It also asked them to "bravely" shoulder the main responsibility in "actively" addressing such problems at the local level. Local supervision and land and resources officials have been ordered to "review" the cases found before last October and to "concentrate strength" to ferret out more, it said. Evidence of concealed deals of ineffective work will trigger an accountability mechanism, under which local leaders will be held accountable for malfeasance. Local supervision and land and resources departments will file monthly reports on the issue.

BEIJING - China welcomed Sudan's acceptance of a joint African Union- United Nations peacekeeping force for the country's troubled Darfur region. A Sudanese diplomat in Ethiopia confirmed on Wednesday that Sudan has accepted the mission after receiving assurances that a "hybrid" AU-UN force of 17,000 to 19,000 troops will not be open-ended and Sudan will remain in control of its borders. "China welcomes the deployment of a hybrid AU-UN force in Darfur and the joint statement," Foreign Ministry spokesman Qin Gang said in a statement posted on the ministry's Web site late Wednesday. "The facts have shown that dialogue and equal negotiation is an effective approach to political solution of the Darfur issue, and the consultation between AU, UN and Sudan is an effective mechanism," Qin said. China recently appointed a special representative for Africa to focus on Darfur, and has publicly urged Khartoum to give the UN a greater role in trying to resolve the conflict. The Darfur conflict began in 2003 when local rebels took up arms against the Sudanese government, accusing it of decades of neglect. Sudanese leaders are accused of unleashing the pro-government Arab militia, the janjaweed, to fight them - a charge they deny.

China, the world's largest tobacco producer and consumer, will ban all forms of tobacco promotion by January 2011.A ban on tobacco advertising has been in place since 1996, but firms have managed to sidestep the rules and promote their brands in other more subtle ways such as sponsoring sporting events, or using their logos without mentioning "cigarettes" on television, radio and in newspapers and magazines.Xu Guihua, vice-president of China Tobacco Control Association, made the landmark announcement on Monday at a seminar in Guangzhou, capital of Guangdong Province. She said the country is committed to fulfill its obligations to the World Health Organization (WHO) Framework Convention on Tobacco Control.China formally became a member of the convention last January.Xu said the nation lags behind other countries in efforts to control the use of tobacco, and the biggest problem is the lack of national regulations banning smoking in public areas.To date, fewer than half the cities have framed rules on smoking bans in some public spaces. Efforts to ban smoking in other areas such as karaoke parlors and restaurants have been stifled by unwilling owners and managers who fear a loss of business.Figures from the Ministry of Health show that China has an estimated 350 million smokers, almost a third of the world's 1.1 billion smokers.Cigarette makers spent more than 1.6 billion yuan (2 million) to promote their brands last year, according to China Youth Daily.In 2005 the government collected 240 billion yuan (.7 billion) in tobacco taxes.According to the WHO convention, tobacco products must carry prominent health warnings on the packaging.This measure needs to be implemented within three years from when China signed the convention.Within five years, China must fulfill it commitment to comprehensively ban all forms of tobacco advertising, promotion and sponsorship.Last year, authorities found there were 231 instances of tobacco promotion considered illegal. The violators were fined a mere total of 1.23 million yuan (2,780).A senior official from China's State Tobacco Monopoly, who did not want to be named, said the administration was "actively taking measures" to fulfill its obligations to the convention.Regulations to further control tobacco promotion on the Internet were expected shortly, he said.Despite a willingness to cooperate, the official said tobacco producers were lawful enterprises, and it was not fair to "butcher the industry"."There is market demand for tobacco, people can choose if they smoke or not," he told China Daily.He said tobacco firms are using scientific and technological improvements in tobacco products to "lower" the harmful effects of smoking.However the WHO has long argued there is no way to make smoking healthier.Yang Yan, a researcher with Chinese Center for Disease Prevention and Control, said 12 percent of deaths in China are caused by tobacco related illnesses, and by 2025, that figure will climb to 33 percent.
