A brand-new labor contract law comes into force from the New Year's Day that is expected to markedly propel rights for billions of Chinese workers."The government that is making the most concerted effort to protect workers rights is China," said Auret van Heerden, Geneva-based head of Fair Labor Association, which monitors work conditions in 60 countries.That "goes against the conventional wisdom that China is leading the race to the bottom," the Bloomberg News quoted Heerden as saying on Tuesday.The Labor Contract Law aims to improve job security for workers, making open-ended terms of employment for those employees who have completed two fixed terms with the same employer. The legislation limits overtime, sets minimum wages and guarantees one month's pay for each year worked for sacked employees. It is the first time that China's top legislature, the National People's Congress Standing Committee, has ruled on open-ended work contracts and severance pay for fired workers.The new law will make it more difficult for companies to hire temporary workers, a practice favored by exporters to cope with fluctuations in orders.One side-effect of the legislation will be higher labor costs for all employers in China. It is estimated that some labor-intensive businesses will have to raise their selling prices, or move to other places with lower cost.Olympus Corp., the world's No.4 digital camera maker, and Yue Yuen Industrial (Holdings) Ltd., the biggest maker of shoes for brands such as Nike Inc., are among companies shifting some production to Vietnam to cut costs.According to Chinese press reports, some companies have been terminating contracts and asking employees to resign ahead of the introduction of the law.Huawei Technologies Co., China's largest maker of telecommunications equipment, offered 7,000 workers new contracts with benefits if they terminated their old agreements, spokesman Ross Gan said.Some employees accepted, while others chose not to sign and left, he said, without providing details. CAPE TOWN, South Africa - Central bank chiefs from the U.S., Europe and Japan warned Tuesday of the risks of the Chinese economy overheating, potentially adding to inflationary pressures in other countries. U.S. Federal Reserve Chairman Ben Bernanke and European Central Bank President Jean-Claude Trichet also urged Beijing to let its currency rise in value, saying it would benefit both China and the global economy. "A quick pace toward greater flexibility would be in China's interest and create more flexibility for monetary policy to address the potential overheating of their economy," Bernanke said in a satellite linkup with a banking conference in Cape Town. "We could all be better off, China on the one hand and the global economy on the other hand," echoed Trichet. Critics argue that China is keeping its currency artificially low, contributing to its massive trade surplus with other countries and undermining competitors' prices. Both Bernanke and Trichet conceded that the cheapness of Chinese products flooding world markets had helped reduce global inflation, although said this was balanced by China's huge appetite for fuel and raw materials -- which has contributed to higher oil prices. Overall, China's impact on global inflation was "modest," Bernanke said. China is one of the world's fastest-growing economies, and its expansion has had a ripple effect on prosperity in other countries and offset more modest growth rates in North America, Europe and Japan. Trichet said the current boom was "absolutely exceptional in the global economy," but warned that this could not last indefinitely. "Complacency would be the worst possible advice for all of us," he said. Japan, where growth is a sluggish 2 percent, is keeping a watchful eye on the new Asian giant. Chinese auditors said it found no embezzlement or misappropriation of construction fund in the ongoing Three Gorges project, however, they also detected some problems and flaws in the project management. The National Audit Office (NAO) said the overall quality control of the project was fine and total investment were kept under control. All 11 major projects were up to the standards, as were main materials such as steel and cement, said an audit report by the NAO. It said total inflation-adjusted investment, expected to be 78 billion yuan, could be more than 35 billion yuan less than planned in 1994. By the end of 2005, the country had spent 64.2 billion yuan on the project. The NAO, however, also detected extra construction costs of 488 million yuan, most of which was incurred by project construction contractors who exaggerated their expenditure. The office also found 20.4 hectares of land illegally used without governmental permission, while another 110 hectares approved for use had been left idle. "The problems are largely due to lack of laws and regulations and imperfection in internal control," said Pan Xiaojun, senior official with the NAO. The company said it had already corrected the use of 139 million yuan of fund involving violation of rules, and a total 17 measures had been adopted to improve management over the project. The office said 21 power station construction projects, most of which involved a single contract value of less than 10 million yuan were not put out to tender. A few construction companies were discovered to have subcontracted their projects against regulations and obtained illegal charge of 53.45 million yuan. About half of the 1,448 supervisors sampled were found to have no licenses for the work. The China Three Gorges Corporation said it had strengthened the implementation of public bidding to ensure the fairness of the results and avoid the influence of people, and it also added detailed terms about contracting in contracts to prevent illegal contracting. The unlicensed supervisors had been fired and supervision over the project supervisors were enhanced, according to the company. The report said that the project across the Yangtze River, the construction of which began in 1993, had played a "better-than-expected" role in flood prevention, power generation and shipping.
